Description

Independently perform the most complex land transaction assignments on a continuous basis; works with all levels of management staff as an advisor involving land appraisals, legal process, and financial negotiations; testifies and lobbies at legislative bodies as directed by superiors; is the primary contact person regarding real estate acquisition, disposition, land rights and relocation issues; and perform other duties as required.
 
Distinguishing Characteristics:
 
This class differs from the Right-of-Way Agent IV in that the Right-of-Way Agent V independently performs the full range of complex and difficult land transaction assignments, whereas the Right of Way Agent IV independently conducts negotiations for the acquisition of real property, rights-of­ way, etc.

Examples of Duties

The following are examples of duties and are not necessarily descriptive of any one position in this class. The omission of specific duties statements does not preclude management from assigning such duties if such duties are a logical assignment for the position and are consistent with the class concept.
  • Performs complex and difficult land transactions, working in partnership with other county departments and land owners to resolve issues, involving a combination of problems including intergovernmental ownership, multi-ownership, relocation, urgency of use, inadequate funding, etc., for acquisition and disposition of lands required for public improvement projects.
  • Serves as staff specialist in recommending proposals for legislative review, makes presentations on projects to decision making and legislative bodies, neighborhood groups, and other stakeholders in recommending proposals for legislative review and represents the division at Council meetings  as a staff resource.
  • Discusses proposed improvements with property owners or their representatives explaining their legal rights, the County's obligations, the basis for the appraisals, any alternate means of settlement, the relocation of property, etc.
  • Receives counter-proposals made by property owners, reports to superiors with recommendations.
  • Drafts correspondence to land owners, legal counsel, government and public agencies regarding proposed land transfers.
  • Coordinates land issues regarding infrastructure master planning efforts with State agencies.
  • Acts as liaison between the property owner and the project engineer in negotiating relocation of improvements or other construction concerns.
  • May be directed to prepare and process requests for condemnation of property.
  • Arranges for payment of minor severance damages to property owners.
  • Develops a list of items needed to acquire property rights based on the requirements of each project.
  • Investigate projects' description, purpose, timetable and impact on the community. Gathers information which will directly affect negotiations.
  • Assists the division in the budgetary process, providing preliminary assessments and justification for project development.
  • Coordinates land use issues regarding infrastructure master planning efforts with State agencies.
  • Prepares, assembles, processes and records all documents required in land transaction matters.
  • Coordinates land acquisition activities with property owners, private consultants, the Department of Public Works, the Department of Finance, the CIP Coordinator, the Department of Corporation Counsel, the County Council, and other governmental agencies.
  • Prepares and maintains schedules, logs, and files on the status of acquisitions.
  • Reviews environmental impact statements, advance construction plans, relocation plans, appraisal reports, and title searches to obtain background information identifying potential problems and possible solutions.
  • Inspects properties to verify accuracy and completeness of appraisal reports and relocation plans.
  • Coordinates and processes deeds, agreements, rights-of-entries, and other legal documents and assures that all documents are properly executed and recorded.
  • Maintains files of completed land acquisitions.

Minimum Qualification Requirements

Training and Experience:  A combination of education and experience substantially equivalent to graduation from an accredited college or university with a bachelor's degree in the field of business administration, public administration, economics, or a related field and three and one half (3 1/2) years of progressively professional experience in real property acquisition and/or appraisals activities, one (1) of which shall have involved negotiating for the acquisition of real property and/or various rights-of-way.
 
License Requirements:  Possession of a valid motor vehicle driver's license (equivalent to State of Hawaii Type 3).
 
Knowledge of:   real estate terminology; laws, rules and regulations governing the administration of lands in the County of Maui; laws, Land Court rules, legal documents and procedures pertaining to land transaction and real property acquisition; methods for determining ownership and clearance of title; the Hawaiian land system; sources of information pertinent to land matters; basic principles and methods of real estate appraisal.
 
Ability to:   interpret and explain laws and regulations; understand and interpret plans and specifications relating to real property acquisition; meet with property owners and/or their representatives and explain the purpose of land acquisition projects; deal tactfully and effectively with the public, other government agency officials and employees; conduct research studies.

The above examination is being given on an open-competitive basis to establish an eligible list which shall be effective for not more than one year unless extended by the Director of Personnel Services.
